mgm Software attaches the highest value to the protection of your personal data. We handle person-related data confidentially and according to the legal data protection regulations.

This website of mgm Software can be used or saved without providing any personal data. When you are asked to provide person-related data (e.g. via a contact form), you do so on a voluntary basis. They build the cornerstones for individual support and business relations. Though, the shared data that was given to mgm Software, too, will be handled internally and confidentially. They will not be given to third parties without explicit consent.

mgm Software is eager to ensure the highest possible protection for your website. Though, it has to be pointed out, that data transmission generally (at times) may exhibit gaps in the security. Hence, a gapless protection of data from third parties cannot be warranted for.

(3) Contact form
When contacting us via the contact form, the data you give will be saved for the duration of the processing. In any case, this will be “Title”, “Name” and “E-mail address”, which describe person-related data. This data will not be given to third parties without explicit consent.

(4) Incorporation of services by third parties
mgm Software, on their website, make use of services or contents of third parties. Thus, it involves linking to other webistes (for further information see „Legal“) and especially also Google Maps. Such service providers mostly need the IP address of users, so that they are actually able to offer their services (or provide contents). The choice of providers for such services or contents is made carefully and with care. We try to only incorporate those, whose providers only use the IP addresses only for the delivery of contents. mgm Software has no influence as to which data of third parties is saved and is not responsible for the data protection of these third parties. We suggest to carefully read the respective data protection regulations of the websites or providers.

We reserve the right to update or change our Privacy Policy at any time should this be necessary due to new technologies, legal or in-house changes.Should there be any fundamental changes made to this Privacy Policy, this will be declared on our website. mgm software attaches great importance to the protection of personal data. We treat personal data sensitively and according to the valid legal data protection regulations. With this mgm privacy policy (short “ADB”) we inform you about all important aspects concerning data processing by mgm Software over the course of making use our services.

We reserve the right to adapt these data protection regulations from time to time, in order to always meet the current technological, legal and business requirements. Therefore, we ask you to read them regularly. If fundamental changes are made, this will be announced by us on our website.

(1) Purpose and legal basis of data processing
mgm Software stores personal data within the scope of a developing and upright business relationship (order, maintenance contract, license agreement) for the purpose of business initiation, order fulfillment and further customer service. In case of no further business relation after initiation (no contractual relation like order, maintenance contract or license agreement) your data remains stored for marketing purposes.

You have the possibility to have your data deleted at any time, provided that they are not necessary for the above-mentioned purposes and no legitimate interest is opposed. In doing so, we always act according to the principle of data minimization and process your data in accordance with the currently applicable national and EU data protection regulations, such as the DSGVO.

(2) Confidentiality and disclosure of data to third parties
mgm Software commits itself and its employees and other vicarious agents to secrecy concerning the data according to article 2 § 6 DSG, as well as in accordance with article 28 DSGVO in the respective currently valid versions.

Data will only be passed on to third parties if this is legally required or necessary for the fulfilment of the contract. This includes external service providers such as tax consultants, auditors, banks and legal representatives for the protection of legitimate interests, legal obligations or for the assertion, exercise or defence of legal claims, as well as other contributors over the course of the business relationship (for further information, please refer to section F) or to authorities or courts in the event of an incident. Otherwise, no data will be passed on to third parties without explicit prior consent.

(3) Contract processing agreement according to Art 28 DSGVO
The section on commissioned data processing contains all the necessary information. If mgm Software acts as contractor and thus as an order processor, these data protection regulations and the presently available mgm standard order processor agreement applies, unless a separate contractual agreement is concluded in individual cases.

Specific uses

Personal-related data for information and advertising purposes

Customers or partners have the opportunity to be informed occasionally via e-mail about news concerning mgm Software. These are informative mailings to customers or partners with whom we have a business relationship. There is always the option to unsubscribe (your e-mail address) – directly within the mailing or with a message (info@mgm.at) to us.
In order to send informative mailings, we need your e-mail address and information which then enables us to determine its accuracy and legality (such as name, company – data that is known in the context of an upright business relationship). This data is collected as a result of either your expression of interest, or, an active business relationship (published e-mail addresses). This collected data is stored and used exclusively for internal purposes and is not passed on to third parties, this also implies your e-mail address and, if applicable, your name for e-mail dispatch. You have the option to cancel your subscription of informative e-mails (via “unsubscribe” in the mailing) at any time, or you can also write us.

Person-related data from applications 

mgm Software processes person-related data from applications for the handling of the application procedure. Only such data will be collected, which are voluntarily provided over the course of the application (by e-mail, post or personally). This person-related data, such as name, address, date of birth and career information, is then only used internally for the application process and only accessible to a limited group of authorized people.

If applicants are not shortlisted, the person-related data provided will be deleted or destroyed or, if necessary, returned (by post). Over the course of the further application process, the collected data will also be deleted or destroyed in the event of a negative outcome and will only be kept on file in exceptional cases by agreement. If an employment relationship is established, the personal data will be used and stored for contractual and legal measures.

 

Order processing according to Art 28 DSGVO

mgm Software Team GesmbH as contractor provides services for its client (customer) within the framework of an upright contractual relationship (such as order, maintenance contract, license agreement). As a result, mgm Software Team GesmbH acts as an order processor for its client, who is responsible according to the DSGVO. Therefore, both parties are required to enter into an agreement on order processing (AVV) according to Art. 28 DSGVO, which defines the subject, as well as the type and purpose of the processing, the type of personal data, the categories of people affected, as well as the obligations concerning data protection regulations and the rights of the parties in the contract.

The object of contract processing is the provision of services or the performance of tasks in connection with the fulfilment of the contractual relationship and further customer care. For this purpose, the contractor processes, among other things, personal data (e.g. name, e-mail address etc.) of the customer and, if applicable, its customers, which have been collected with a person responsible from the customer, or, which have been made known or made available by the customer.
